The next AusIMM ConSoc webinar tracing a journey through the Minerals Consultant Handbook will focus on Disputes and Liability. This will cover Chapters 12, 13, and 14 in the Mineral Consultants Handbook.

About this event

Our presenters include Geoff Pitkin, Brian Baumhammer, Greg Hansen, Colin Roberts and John Dunlop.

Liability & Legal Risk authors will be joined by Austbrokers to discuss liability and risks, from a legal perspective. The points made and examples discussed are intended to throw light on potential areas of legal risk, rather than to be regarded as legal advice.

Nearly all contracts have disputes clauses which set out, amongst other things, what constitutes a dispute, how it should be identified, how it should be resolved and by what means. Alternative dispute resolution methods are described, together with some background as to how they are usually conducted, where and by whom.

Intellectual property will also be discussed, including case study examples, providing an understanding of this topic to the mineral consultant.

Greg Hansen

Greg Hansen is a Director at Austbrokers Countrywide who is a General Insurance Broker that arranges insurance coverage for AusIMM members. For 25 years Greg has been arranging insurance products for the minerals and mining sector acting for both for Insurers paying claims and also acting as the Insurance Broker representing you the end client. Austbrokers Countrywide has had a long association with AusIMM and its members. The development of a Professional Indemnity and Public Liability insurance scheme for AusIMM members is the most common insurance products purchased by members of the AusIMM Consultant Society. By managing the operation of this insurance scheme Greg has obtained a lot if insight into professional negligence claims and the sorts of activity areas that Insurers see as high risk and are concerned about litigation risk. Greg regularly offers advice to members on insuring all sorts of risk including environmental and underground risks, working in overseas jurisdictions and reserve/resource estimation risks.

Discussing and reviewing contracts for AusIMM members is another key piece of risk management advice offered by Austbrokers Countrywide. Greg regularly deals with members advising on amending contracts to ensure there are no gaps between contractual liabilities being agreed too and the cover being provided by insurance product covers.

John Dunlop

Mr Dunlop is a certified Mine Manager having approximately 50 years of international surface and underground mining experience in a variety of base metals, industrial and precious metals production.
He is a current Director of the Australasian Institute of Mining and Metallurgy (AusIMM) and Chairman of its Policy & Advocacy Committee as well as its Consultants Society.
Mr Dunlop is a highly experienced mining professional having been involved in the design, construction and on-going operation of a number of major resource projects throughout the world.
He has operated his own mining consulting practice spanning approximately 40 countries since 1992 and was the original editor of the AusIMM’s Mine Manager’s Handbook and author of the first edition of the Mineral Consultant’s Handbook.

Geoff Pitkin

MAusIMM (CP)
Geoff has over 46 years’ experience in the New South Wales and Queensland coal industries with a background in open cut and underground operations, new mine development and the preparation of feasibility studies. Geoff has worked as a consultant for the last 29 years. He has developed particular skills in the areas of dragline operations, the application of mining technologies, mineral economics and finance, software development, strategic planning and project management. Geoff has managed and performed major feasibility and prefeasibility studies, strategic studies at both the corporate and business unit level, technical and due diligence reviews, financial studies and valuations, equipment comparisons and justifications, rehabilitation studies and short and long term planning. Geoff has also acted as an expert witness for a number of court cases. Geoff is also a Competent Person under the JORC Code.

Geoff has been a member of the AusIMM for 43 years. He has also been a comittee member of the Hunter Branch of the AusIMM for 11 years. In this capacity Geoff has organised and presented at a number of JORC seminars and coal mining conferences aimed at improving professional practice.

Brian Baumhammer

Brian has more than 35 years’ experience in coal and metals operations across Australia and Indonesia in many different mining environments. Within this experience he has held a wide range of roles with a strong management and technical background. He has been responsible for managing mining engineering operations on sites including PT KPC, Mount Thorley-Warkworth, and HI’s Channar operations. His technical capabilities have been developed through his involvement in the development and management of mining contracts for large scale operations, the development of operational and logistical expansions of operations and strategic planning for development and successful operations.

Brian has worked as a consultant for 12 of the last 15 years. He has developed capabilities of Project Directorship and Project Management which have been used in Conceptual, Pre-Feasibility, Feasibility Studies and Technical Reviews associated with mine developments, Mergers and Acquisitions and Due Diligence evaluations. He is a ‘Competent Person’ as defined in the JORC Code and has experience as an ‘Independent Technical Expert’, having prepared or been participant in many Due Diligence and IPO reports of projects in Australian and Indonesian coal and metals operations.

Brian has been a member of the AusIMM for 36 years. Brian has presented a number of papers at seminars and coal mining conferences aimed at improving industry practice.
